Tax implications for using different address

Howdy Frank, So here is the situtation. Me and the chic kidna temporary moved back to LI. So she got a job out on LI im still schooling in NYC and working in NJ. No problems on my end. She got a job locally but is using her moms address on her w-4 (i think that is the form) Is she going to have any types of problems or was she better off using the PA address to pay lower taxes? Should she change it or leave it? Thanks

kinda - yikes hate that word when doing taxes. you - basically your state of residency is where you need to file. if PA is home then you file in pa as a resident. But temporary could come back to bite you. if you spent 184+ days there you are considered a NY resident. NY as nonresident. NY may be interested in the W-2 having NY address though. As part of the information you will need to enter the number of days spent in NY. Watching the number of days is very important.

So she should change it back to PA and hope that NY State doesnt notice? I think they have been taking out the taxes. But if she was listed as living in PA and working in NY then she would have to pay both taxes. So i would assume that she might be better just keeping it as a NY address and let my tax guy deal with it next year?

you get credit for taxes paid to ny in pa. NYS would withhold regardless. Depending on the income levels NY could be cheaper because it has a similar tax structure as the Federal - it allows for standard and itemized deductions. PA is a flat tax state basically. legally you can't decide what state you want to file in - (well you could by not living there or working there lol). residency status has a few steps - the biggie is time spent living there. you should tell your tax prep person whats going on - they will/should fill you in as to the potential tax bill you might get.
