What forms to complete - Monday, April 02, 2007 7:15 AM
My wife and I moved to PA in August of 06.  We both work in NY and would like to know what forms other that our federal do we complete to be in tax compliance for 2006.  County, State...? Do we still file NY taxes?
Any and all help would be great. We tried a link posted on another thread but even when we log on access is denied.

for local

go to this state site http://munstatspa.dced.state.pa.us/FindLocalTax.aspx?T=1 and enter your address - click find municipality.  it may list other townships - double check the county before selecting. then click view report.
the first line of the report is what you are concerned with for now.  the Earned Income Tax (EIT).  The far right has the total tax.  usually its just 1%.

on the bottom it notes who your tax collector is.  not all have a website. 

if you had left over credit for taxes paid to NY on your pa return, you can use it at the local level.  its the lower of the remaining credit or the tax bill.  you will need to submit a copy of your NY return and schedule G.  Generally on the back of the local returns is a little worksheet to help you figure it out.

If you can't get a local return, I can email you a generic one.

Don't let all the info scare you, its not that bad lol

Oh for PA, don't forget to prorate for just the period that you were here (aug - dec), same for the local.

you won't have to worry about IT203-c since both of you work in NY.  it is basically a form that the spouse working in NYS is the only one.

After reading the instructions for pa-40 it stated who must and who shouldnt file.
i am confused because it states that you should not file a pa-40 if you have not received total PA gross taxable income in exess of $33 in 2006.  My wife and I receive no income from PA sources do will still file the pa-40?

step back - careful it doesn't quite say that.

if you are a non-resident and have pa source income you need to file - example.  you live in Alaska but have rental property in PA.  You have to file in pa because it is pa income.  you will have to also file in alaska (if they have income taxes).  it will probable have a means to take a credit for taxes paid to another state and if you paid more you probably won't owe anything to alaska, but if alaska's tax is higher you will need to come up with the difference.

now your situation - pre Aug you owe zero to pa since you were not living here nor working here.
post July - you moved here and while you were here you generated income from somewhere (anywhere).  if that income is greater than 33 you will need to report it to pa.  now the fun begins.  you will also have to report it where ever it was earned.  So your wages were earned in NY.  NY wants its tax money on that even though you don't live there.  PA wants its share of tax money on that income but it has to carefully thread the line because it could be double taxation and thats a no-no.  It allows for credit for taxes paid to another state (schedule g) that it doesn't have a reciprocal agreement with.  PA does not have an agreement with NY.  Odds are your NYS taxes will be more than the PA tax on that same income, so you will not be paying anything to PA.

now pa does not recognize 401k's so if you contributed a lot of money to 401k you open that part up to taxation in PA because it wasn't tax elsewhere.

same thing for local, sort of.
